Terms of Service may be updated without prior notice
By commissioning me, Shiro (the artist), you (the client)
agree to the following terms and conditions:1. Scope of WorkThe Artist agrees to create a custom 3D model based on the specific requirements outlined in the commission request by the Client. The final product will be delivered in the agreed-upon file format(s).2. LicensingPersonal License:
The Client is granted a personal license to use the 3D model for personal, non-commercial purposes. This includes all activities as long as the client is not monetizing content in any way.Commercial License:
If the Client wishes to use the 3D model for commercial purposes (e.g., make videos), they must purchase a commercial license. The commercial license includes all rights granted under the personal license, as well as the right to profit from the model in transformative mediums.The commercial license may incur an additional fee, which will be outlined during the commission discussion.3. Payment TermsAll payments are to be made through PayPal. The Client is responsible for covering any PayPal transaction fees. There will be two transactions. 50% before start of work and 50% after delivery of model.4. Refunds & CancellationsRefund Policy: If the Client requests a refund, the Artist will retain 50% of the initial deposit as a cancellation fee, and the remaining balance will be refunded.Chargeback Policy: If the Client initiates a chargeback through PayPal or another payment method, the Artist reserves the right to block the Client from future commissions and discontinue all communications. This will be enforced to prevent fraud and ensure fair transactions.5. Delivery TimelineThe Artist will provide an estimated delivery timeline based on the complexity of the commission. However, the Artist is not liable for any delays caused by external factors such as technical issues or personal circumstances. The Artist will make reasonable efforts to meet the agreed timeline.6. Client ResponsibilitiesThe Client must provide clear and detailed reference material and communication regarding the 3D model’s specifications.The Client is responsible for reviewing progress updates and providing feedback promptly. Delays in feedback may result in delays in the delivery of the final product.7. Copyright & OwnershipThe Artist retains the copyright to the 3D model until full payment is received. Upon receiving full payment, the Client will receive the rights outlined in the Personal or Commercial License.The Artist may use the model for portfolio purposes, promotional work, and as examples of their artistic style. If the Client prefers not to have their work showcased, they must request this in writing prior to commissioning.8. IndemnificationThe Client agrees to indemnify and hold harmless the Artist against any legal claims, damages, or expenses arising from the use of the 3D model, especially in cases of commercial use, where the Client is fully responsible for ensuring the model’s compliance with applicable laws.9. General ProvisionsThese Terms of Service may be updated at any time by the Artist. The Client will be notified of any changes via the method of communication provided during the commission process.By proceeding with a commission, the Client acknowledges that they have read, understood, and agreed to these Terms of Service.
Frequently Asked Questions
Q. I want to request an OC! What's the criteria for that?
A. You must either own or have permission from the original creator to get the model made. A good reference sheet is also required to apply for OCs.Q. I want to request a character from a series! What's the criteria for that?
A. The owners of the series should be okay with fan made creations of their characters. Be sure to check the secondary creation guidelines. For example Blue Archive allows it.Q. What will be the procedure?
A. Half the fees will be paid before the start of the project and half after completion. The transaction fee will be covered by the client in both times.Q. What's the mode of payment?
